This Privacy Policy explains how Black Diamond Equity Partners LLC, a Wyoming limited liability company, together with its affiliates, members, managers, officers, employees, and agents (collectively, “BDEP,” “Company,” “we,” “us,” or “our”), collects, uses, stores, discloses, and protects information in connection with this website and its associated dashboards, tools, and databases (collectively, the “Platform”). This Privacy Policy is incorporated by reference into our Terms of Service and should be read together with it.
The Platform is a private, access-restricted business tool used by BDEP to manage its real estate acquisition pipeline. It is not a public consumer service. Access is limited to authorized users to whom BDEP has granted credentials.
1. Information We Collect
We collect the following categories of information through the Platform:
1.1 Account and Authentication Information. When an authorized user is granted access, we collect and store credentials and related authentication data (such as email address and securely hashed passwords) necessary to create and secure the account. Authentication is handled through our third-party infrastructure provider (see Section 3).
1.2 Property and Transaction Information. The core function of the Platform is to store information about real estate properties and transactions that BDEP is evaluating, pursuing, or tracking. This includes property addresses, parcel data, valuations, financing terms, deal status, underwriting assumptions, and related notes entered by authorized users.
1.3 Third-Party Individuals. In the course of tracking transactions, the Platform stores information about individuals connected to those transactions who are not users of the Platform, such as property owners, sellers, brokers, counterparties, lenders, and business contacts. This information may include names, entity affiliations, contact details, and ownership or transaction history, much of which is derived from public records such as county registries of deeds and property appraiser records.
1.4 Uploaded Documents. Authorized users may upload documents to the Platform, such as deeds, purchase agreements, financing documents, and related materials. These documents, and any personal or financial information contained within them, are stored as part of the transaction records to which they relate.
1.5 Financial and Investor Information. The Platform may store financial information relating to transactions and, where applicable, information relating to prospective or actual capital sources and investors. Any such information is used solely for BDEP’s internal business, transaction management, and compliance purposes.
1.6 Location and Address Data. To display properties on a map, the Platform transmits property addresses to a third-party mapping and geocoding service in order to convert them into map coordinates (see Section 3).
1.7 Technical Information. Our infrastructure providers may automatically collect standard technical information incidental to operating the Platform, such as IP addresses, access timestamps, and log data, for security and operational purposes.
2. How We Use Information
We use the information in the Platform solely for BDEP’s internal business purposes, including to: operate and secure the Platform and authenticate authorized users; evaluate, pursue, track, and manage real estate acquisition opportunities and transactions; maintain internal records of properties, counterparties, and transaction history; display properties geographically; and comply with applicable legal, regulatory, and recordkeeping obligations. We do not use the information in the Platform for advertising, and we do not sell it.
3. Third-Party Service Providers
The Platform relies on a limited number of third-party service providers that process or store information on our behalf:
3.1 Infrastructure and Database Provider. Our database, authentication, and file storage are hosted through a third-party backend infrastructure provider. Information entered into or uploaded to the Platform, including account credentials, transaction records, and uploaded documents, is stored on infrastructure operated by that provider, subject to its own security practices and terms.
3.2 Mapping and Geocoding Provider. When properties are displayed on a map, property addresses are transmitted to a third-party mapping and geocoding service to obtain map coordinates. Additional service providers may be engaged as the Platform develops; where they process information on our behalf, they are engaged for the limited purposes described in this Privacy Policy.
We do not sell personal information to any third party. We may also disclose information where required to comply with applicable law, regulation, subpoena, or governmental request, to enforce our agreements, or to protect the rights, property, or safety of BDEP or others, and in connection with a merger, acquisition, financing, or sale of assets involving BDEP.
4. Information from Public Records
A significant portion of the property and ownership information in the Platform is compiled from publicly available sources, including county registries of deeds, property appraiser and assessor records, and business entity registrations. Such information is collected and used for BDEP’s legitimate business purposes in evaluating and pursuing real estate transactions.
5. Data Security
We rely on the security measures of our infrastructure providers, together with access controls limiting the Platform to authorized users, to protect information from unauthorized access, use, or disclosure. No method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.
6. Data Retention
Because the Platform functions as an ongoing internal record of BDEP’s transaction history, information is generally retained for as long as it remains relevant to BDEP’s business, or as necessary to satisfy legal, accounting, or recordkeeping obligations, after which it may be deleted or archived in accordance with our internal practices.
7. International Data
BDEP maintains family, capital-source, and business relationships outside the United States, including in Brazil. Where information relating to individuals located outside the United States is entered into the Platform, that information is stored and processed in the United States or in other jurisdictions where our infrastructure providers operate, which may have data protection laws different from those of the individual’s jurisdiction of residence.
8. Individual Rights
Individuals whose information is stored in the Platform, including non-user third parties such as property owners and counterparties, may, depending on their jurisdiction and applicable law, have rights to request access to, correction of, or deletion of their personal information. Requests will be evaluated and honored to the extent required by applicable law, subject to BDEP’s legitimate business interests and legal obligations, including its need to maintain accurate transaction records. 9. Children's Privacy
The Platform is a private business tool that is not directed to or intended for use by individuals under the age of eighteen (18), and it does not knowingly collect information from children. BDEP does not knowingly collect personal information from children under the age of thirteen (13) in a manner inconsistent with the Children’s Online Privacy Protection Act (“COPPA”). If we become aware that we have inadvertently done so, we will take reasonable steps to delete that information.
10. Changes to This Privacy Policy
We may update this Privacy Policy from time to time in our sole discretion. Changes are effective upon posting to the Platform, and the “Effective Date” above will be updated accordingly.
11. Notices
Any notice or request under this Privacy Policy, including any request relating to the access, correction, or deletion of personal information, shall be directed in writing to BDEP’s Data Compliance Officer at info@blackdiamondequitypartners.com. We will respond to any verified request within the timeframe required by applicable law.
